We got my brother back, today. <3

When we called the police, they said there was nothing we could do because neither parent legally had custody. Therefore, my little brother’s father was technically allowed to steal him away from us without consequence. What we could do was file for a parenting plan and ask that my brother be returned to us. There was a danger though, because the officer said that if Nick had already filed, he’d basically have dibbs. It’s a shitty system, but it’s true. My mom went the next morning first thing and filed.
We beat him, and my mom asked that my brother be returned ASAP, at least until the final hearing in November.

Nick (my brother’s father) tried telling the judge (at the pre hearing at 9:30 AM today) that my mother was unsuitable to raise his son. The judge interrupted and said that, with Nick’s background (multiple DUIs and the like) he was not going to grant him custody. Nick tried then to say that my mother’s trailer was not a fit place to raise a child and that he had a house. The judge once again interrupted and said “Even if you had a mansion, I would not grant you custody of this child.”

The final hearing on Nov. 30th should be simple. Mom has a file from my brother’s old preschool of all the things my little brother told them about his dad, including that he drinks all the time. They also wrote a letter stating that when my brother lived with my mom, he always came to school clean, happy, and healthy. We’ve won.
That fucker will never take my brother again. <3 

My five year old, beautiful little brother held my mother’s hand in both of his the whole way home.
